CIA Destabilizing Pakistan


Nowhere in the world a country is subjected so rigorously and intensively to destructive clandestine activities, be they overt or covert, as Pakistan is by the CIA.


It’s CIA’s war based on flawed intelligence on which a national strategic plan of the US security is formulated called the AFPAK strategy. US security concerns has put Pakistan on highway to destabilization. The strategy has an overt face of an aid package of $1.5 billion annually along with certain US personalities like Richard Holbrooke and Admiral Mike Mullen visiting us very frequently and assuring us of their full support. But there is a covert face to this, one run by the US intelligence for which we as a nation are paying heavily at the cost of our sovereignty and stability.No matter what is the people’s mandate or what great democratic institutions we intend building, whether it is the PML- N or PPPP the ruling party will matter least as long as the CIA keeps the drones overhead, expands the occupation in Afghanistan and increases clandestine intelligence activities.
The CIA is fully assisted by RAW in Balochistan. MI6, Mossad are rendering operational and counter support. The successors to the KGB have scores to settle with ISI and CIA and are fully involved as a spoiler trying to involve more US and Pakistan men and material in the region to avenge their biggest defeat in Afghanistan. KGB and RAW were old partners in the Cold War and their successors continue to enjoy cordial relationship and are eyeing at their mission to collapse Pakistan.The region is infested with variety of Taliban, CIA Taliban, Mullah Omer Taliban, KGB Taliban, Punjabi Taliban, ISI Taliban, warlords of the Mujahideen, drug cartels, al Qaeda terrorist groups, extreme religious fanatics, mercenaries and foreign troops all interlinked to one another, each trying to rule, plunder, loot and kill in the name of Islam. The CIA with the overall command assisted by the US and NATO troops dominates Pakistan ruling class and dictates its requirements at all levels to do more. It alleges ISI involvement with the Taliban with the result the trust has diminished at both ends.
The CIA wants ISI to weaken or neutralized, so that they could have a free run to our nuclear assets. We are in the most precarious situation from all directions. It is become too complicated and complex intelligence situation with no victors or vanquished in sight.The track record of CIA’s operational and counter intelligence activities is extremely chequered. Their graph speaks volumes of their inefficient organization, incompetent manpower, wrong propaganda and misuse of their capabilities. The destructions they have caused and the brutal killings of the innocent people by the thousands have made people hate Americans especially in the Muslim world. Turmoil that we inherit today is US government blunder for withdrawal from Afghanistan in 1990 when the region needed them the most.
The creation of militant Taliban, re-organizing and strengthening of al Qaeda are all the out come of American strategy evolved few months before 9/11. The region has spun out of control right from the day when the CIA gave a false and exaggerated finished intelligence to the US President on 9/11 episode accusing both the Taliban and al Qaeda from this region. The wrong intelligence estimate united not only both the groups but the over all command structure shifted to al Qaeda as the American propaganda gave hyped projection to this terrorist group much above its capabilities. Osama bin Laden became a Muslim world hero. His organization still remains obscure with billion of dollars and thousand of people massacred to locate one Osama.The time has come to take the situation in our own hands, though very late.
Pakistan political government needs to take initiative, they need to get out of camera sessions and get the people’s confidence to lead. The Pakistan Army I consider the best fighting machine and with more political stability and people’s backing in the country the army can go stronger and its morale higher. Let us rise above party politics and stand united.

Let’s give our army full support and make ISI conduct the operation with full backing from all political parties, government and the media.

The Impact Of Pakistan’s First Indigenous JF-17 Thunder Squadron Deployment


The impact of the JF-17 Thunder deployment can be heard far beyond Islamabad and Peshawar. Pakistan has now joined the ranks of the very few countries of the world that can design, produce and manufacture airplanes. This positions Pakistan on new geostrategic map. Within a few years Pakistani exports of the new fighter aircraft will exponentially grow into huge volumes. The revenue from the export of JF-17 Thunder will be ploughed back into research and development and the purchase of the best technology money can buy.

After the 1965 war the U.S. placed an arms embargo on Pakistan. Despite being a founding member of SEATO and CENTO, Islamabad faced the American sanctions. During the 1971 war Pakistan was under another American arms embargo. During the 1990s, after winning the cold war for the USA, Pakistan was under U.S. sanctions and an arms embargo.

All this is history.


Today Pakistan is capable of producing as many planes as it needs–subject to production capacity constrains which can be ramped up if and when needed. The exports to many third world countries will expedite and enhance the production capacity of the Pakistan Air Force.

Now the Sri Lankans can have as many planes they want to fight the Indian sponsored Tamil terrorists. And the Middle Eastern Air Forces can begin flying the JF-17 Thunders without begging the U.S. And the small countries of Africa can own their own JF-17 Thunders without selling their souls to the Europeans.

Pakistan has not only designed and jointly built the JF-17 Thunder, it now has deployed its first squadron in Peshawar–all in record time, one of the shortest time lines in the history of aviation. This is a major milestone for the Pakistan Air Force and brings it one step closer to becoming a major producer and exporter of planes around the world. About 17 countries are interested in the JF-17 Thunder which was a major attraction at the Pakistani IDEAS 2009 defense show this year. The success of the indigenous JF-17 deployment is a success story in many aviation failures around the globe. The American F-111, the Israeli Lavi and the Indian Tejas are notable examples of abject failures. The most recent victims of failure is the American F-22 Raptor which was recently canceled by the U.S. Department of Defense.

This success story of developing and manufacturing advanced weapons in Pakistan is not limited to the JF-17 Thunder. The Nuclear bomb, the missiles and the tanks were all produced in record time, considering that Pakistan had only one dysfunctional Textile Mill, one dilapidated University, and one archaic Jute Mill in 1947. No other country has come so far in defense production in such a short period of time.

It took the Japanese from the Meiji revolution of 1893 to 1940 to produce the deadly aircrafts that devastated Pearl Harbor. The first American missiles and the entire Apollo program was built on Von Braun’s German technology. The Russian program was similarly also based on the German programs. In fact the first V2-rockets in the Museums in Washington are simply German rocket painted red 9for Russia) and other colors for America.

The acidity of the comments from across the Radcliffe Line is palpable. The Indian press is noticeable only by its asphyxiated constipation. The silence is deafening.

Pakistan rebounding from volatile events faced issues with many of its “allies” who were also the suppliers. The USA did not want to sell any arms to Pakistan. The UK and Russia did the same. Pakistan evaluated her dangerous geo political situation as well as a belligerent international atmosphere and made some strategic decisions. The sons and daughters of Pakistan pledged “Never again” and developed a comprehensive strategy to be self-sufficient in her defense needs. It created a Nuclear deterrent, indigenous
Al Khalid Tanks and a missile program that is the envy of South Asia. Neither the mercenaries sent from the across the border, not the blackmail can now harm the fabric of the country.

The Pakistan Airforce knew its needs, and prioritized its requirements. Both Pakistan and China had been jilted and were looking for plane to build. The new plane has exclusively been designed for Pakistani needs–deep penetration into India. The JF-17/FC-1 is designed to be a cost-effective plane which can meet the tactical and strategic needs of the Pakistani Air Force.The project was originally expected to cost about U.S. $ 500 million, divided equally between Pakistan and China. Each plane will cost Pakistan about US$ 15-20 million. The JF-17 Thunder initial development project was completed in a record period of four years. However, later improvements to the project has taken up more time.

Do more Mr, Brown..DO more

Gordon Brown received an apparent snub today as he arrived in Pakistan for talks with President Zardari only to be told that he was not available to appear at a joint press conference.

The Prime Minister, who landed in Pakistan this afternoon after talks in Afghanistan, told reporters on the plane that he would hold a meeting with the President.

But instead of a joint press conference with Mr Zardari in Islamabad, Mr Brown appeared alongside the relatively junior Pakistani Prime Minister, Yusuf Raza Gilani.

Downing Street tried to play down reports that the President had cancelled the press conference at the last minute as a snub to Mr Brown.

“It is entirely appropriate that he has a press conference with his counterpart,” a No 10 spokesman said. However, on his last visit to Pakistan in December, Mr Brown and Mr Zardari did stage a joint press conference.

The private meeting between the two leaders has so far yet to go ahead.

Mr Brown was visiting the region today to discuss Britain's new strategy for dealing with the terror threat on the Pakistani-Afghan border, as international alarm spreads over Taleban advances. The Prime Minister spoke to British troops at Camp Bastion, their main base in Helmand province, this morning.

He also visited a military hospital, before moving to Kabul, the Afghan capital, for discussions with President Karzai.

“This area and the border between Afghanistan and Pakistan is the crucible for global terrorism,” Mr Brown said, in a speech to the troops.

“It’s important to recognise that if we do not take action and we do not fight back against the Taleban and al Qaeda in Afghanistan and Pakistan, then people in Britain and in other countries represented here are less safe.”

British troops in Helmand will be reinforced in coming weeks by the arrival of more than 8,000 US Marines, a massive influx that NATO commanders hope will reverse what they have described as a stalemate in one of the country’s most violent provinces.

Asked what Britain would do about instability on the Pakistani side of the border, Mr Brown said: “It’s clear ... that we cannot sit by and allow this centre, or epicentre, of terrorism to continue to exist without taking further action.”

It is people like Brown who are too hasty to SHOW off their loyalties to the actual bosses in Washington and Tel Aviv ..in a situation where his popularity is dropping immensely in his country, and Economic situation has become more of a PERMANENT crisis, he needs his bosses more than ever and thus he will do all he can to please them.

Operation Pathway ..in any other times such as that of even Tony Blair's when lying had become more of state norm from the British Govt, no such example can be cited. A totally Farce, Racist , and Discriminatory behavior from UK govt has resulted in its alligning with all those forces who make mistakes and show the world they there were made ON purpose..

Pakistani Students ..all 12 of them were not charged of any crime despite working day and night towards doing so ..yet arrested and DEFAMED ...and harrassed.Infact not only it tarnished and tainted the face of So 'HARMONIOUS' society of UK ..it indeed exposed its true face to the world.

Anti Pakistan Conspiracy .. The Trust Fund

An international conspiracy to split Pakistan into two zones by turning them into two separate geographic units was foiled by a brotherly Arab Muslim country in Dubai a week before the Tokyo meeting of the Friends of Pakistan Forum.

A plan to set up the so-called ‘Trust Fund’ was drawn up for provision of ’special aid’ to the provinces of Balochistan and the NWFP with huge amount of international assistance separately - meant to disconnect them from the rest of the country. The idea was reportedly widely accepted by senior officials in Pakistan and even some high-ups in Islamabad considered it a ‘lucrative’ and ‘harmless ‘ proposition.

The News that some Western countries campaigned for making the idea acceptable to all the participants of the Dubai meeting. Several calls were made from Abu Dhabi to different world capitals to get the approval of the Dubai meeting but the country in question, who enjoys tremendous esteem in the Muslim world and has a leading role for the Muslim Ummah, came in the way of the proposal. This country delayed announcing its contribution for the Tokyo meeting. It threatened that if the West continues to press for the proposal, it would publicly announce its opposition to the idea and may stay away from the forum, the sources said.

This leading Muslim country was of the view that once the Trust Fund was established, it would be used as conduit for the dismemberment of Pakistan. The diplomats expressed apprehension about Pakistan’s interests and said once the Trust Fund became effective, the United Nations would be subsequently asked to come forward to play its role for the region to the detriment of Pakistan.

It was feared that in a calculated step, international financial institutions would contribute billions of dollars in the name of rehabilitation of those areas. Later, they would ask the world body to come forward to play its role to save their huge investment there.

Thus the move would have the mandate of the United Nations to give it the cover of legitimacy. This could have cut Pakistan to size on the one hand and paved the way for the creation of a buffer state between Pakistan and Afghanistan on the other hand. Most of the bordering countries of Pakistan would have supported such a division.

For the reason, the respected leading Muslim country insisted that any assistance for any region within the territory of Pakistan must be routed through the authority of Pakistan.

Shaukat Tarin, Adviser to the Prime Minister on Finance and Economic Affairs, told The News that the proposal for the creation of the Special Fund was deferred. He revealed that Pakistan had sought $2.5 billion for security purposes while $4 billion for education, health and other welfare activities. However, Pakistan was assured of $5.5 billion aid, an amount beyond its expectations.

To a question, he said the security requirements and the Trust Fund would be taken up again after the Pakistan Development Forum (PDF) meeting to be held in May/June next. The government will also knock the doors of the IMF for the fund, Shaukat Tarin added.

How to Clear the Mess !!!

The reason why there is so much despondency in Pakistan is because there is no road map to get out of the so-called War on Terror - a nomenclature that even the Obama Administration has discarded as being a negative misnomer. To cure the patient the diagnosis has to be accurate, otherwise the wrong medicine can sometimes kill the patient. In order to find the cure, first six myths that have been spun around the US-led “Global War on Terror” (GWOT) have to be debunked.

Myth No. 1: This is Pakistan’s war

Since no Pakistani was involved in 9/11 and the CIA-trained Al Qaeda was based in Afghanistan, how does it concern us? It is only when General Musharraf buckled under US pressure and sent our troops into Waziristan in late 2003-early 2004 that Pakistan became a war zone. It took another three years of the Pakistan army following the same senseless tactics as used by the US and NATO forces in Afghanistan (aerial bombardment) plus the slaughter at Lal Masjid, for the creation of the Tehreek-i-Taliban Pakistan (TTP). If our security forces are being targeted today by the Taliban and their suicide bombers, it is because they are perceived to be proxies of the US army. Iran is ideologically opposed to both Al Qaeda and the Taliban yet why are its security forces not attacked by terrorists? The answer is because their President does not pretend to be a bulwark against Islamic extremism in return for US dollars and support.


Michael Scheuer (ex-CIA officer and author of the book Imperial Hubris), writing in The Washington Post in April 2007, cited Musharraf’s loyalty to the US even when it went against Pakistan’s national interests by giving two examples: the first was Musharraf helping the US in removing a pro-Pakistan Afghan government and replacing it with a pro-Indian one; and, the second, for sending Pakistani troops into the tribal areas and turning the tribesmen against the Pakistan army. To fully understand Musharraf’s treachery against Pakistan, it is important to know that almost a 100,000 troops were sent into the tribal areas to target around 1000 suspected Al-Qaeda members - thus earning the enmity of at least 1.5 million armed local tribals in the 7 tribal agencies of Pakistan.

The most shameful aspect of the lie that this is our war is that the government keeps begging the US for more dollars stating that the war is costing the country more than the money it is receiving from the US. If it is our war, then fighting it should not be dependent on funds and material flowing from the US. If it is our war, why do we have no control over it? If it is our war, then why is the US government asking us to do more?

Myth No. 2: This is a war against Islamic extremists ó an ideological war against radical Islam

Was the meteoric rise of Taliban due to their religious ideology? Clearly not, because the Mujahideen were equally religious - Gulbadin Hekmatyar (supported by the ISI) was considered an Islamic fundamentalist. In fact, the reason the Taliban succeeded where the Mujahideen warlords failed, was because they established the rule of law - the Afghans had had enough of the power struggle between the warlord factions that had destroyed what remained of the country’s infrastructure and killed over 100,000 people.

If the Pushtuns of the tribal area wanted to adopt the Taliban religious ideology then surely they would have when the latter was in power in Afghanistan, between 1996 and 2001. Yet there was no Talibanisation in the tribal areas. Interestingly, the only part of Pakistan where the Taliban had an impact was in Swat where Sufi Mohammad started the Shariat Movement. The reason was that while there was rule of law (based on the traditional jirga system) in the tribal areas, the people of Swat had been deprived of easy access to justice ever since the traditional legal system premised on Qazi courts was replaced by Pakistani laws and judicial system, first introduced in 1974. The murder rate shot up from 10 per year in 1974 to almost 700 per year by 1977, when there was an uprising against the Pakistani justice system. The Taliban cashed in on this void of justice to rally the poorer sections of Swat society just as they had attracted the Afghans in a situation of political anarchy and lawlessness in Afghanistan. It is important to make this distinction because the strategy to bring peace must depend on knowing your enemy. Michael Bearden, CIA station chief in Pakistan from 1986 to 1989, wrote in Foreign Affairs magazine that the US is facing the same Pushtun insurgency that was faced by the Soviets in Afghanistan. According to him, as long as NATO is in Afghanistan, the Taliban will get a constant supply of men from the 15 million Pushtun population of Afghanistan and the 25 million Pushtuns of Pakistan. In other words, this Talibanisation is not so much religion-driven as politically-motivated. So the solution to the problem in the tribal belt today does not lie in religion and “moderate” Islam but in a political settlement.

Myth No. 3: If we keep fighting the US war, the super power will bail us out financially through aid packages.

Recently, the Government’s Adviser on Finance stated that the war on terror has cost Pakistan $35 billion while the country has received only $11 billion assistance from the US. I would go a step further and say that this aid is the biggest curse for the country. Not only is it “blood money” for our army killing our own people (there is no precedent for this) but also nothing has destroyed the self-esteem of this country as this one factor. Moreover, there is no end in sight as our cowardly and compromised leadership is ordered to “do more” for the payments made for their services. Above all, this aid and loans are like treating cancer with disprin. It enables the government to delay the much needed surgery of reforms (cutting expenditures and raising revenues); and meanwhile the cancer is spreading and might become terminal.


Myth No. 4: That the next terrorist attack on the US will come from the tribal areas.

First, there is an assumption, based purely on conjecture, that the Al Qaeda leadership is in the tribal areas. In fact, this leadership could well be in the 70 % of Afghan territory that the Taliban control. More importantly, given the growing radicalisation of the educated Muslim youth - in major part because of the continuing US partiality towards Israeli occupation of Palestinian land - why can it not follow that the next terrorist attack on the US could come either from the Middle East or from the marginalised and radicalised Muslims of Europe, motivated by perceived injustices to Islam and the Muslim World.

Myth No. 5: That the ISI is playing a double game and if Pakistan did more the war could be won.

If Talibanisation is growing in Pakistan because of the covert support of ISI in the tribal areas, then surely the growing Taliban control over Afghanistan (70 % of the territory) must be with NATO’s complicity? Surely a more rational understanding would be to see that the strategy being employed is creating hatred against the US and its collaborators. Aerial bombardment and its devastating collateral damage is the biggest gift the US has given to the Taliban. According to official reports, out of the 60 drone attacks conducted between 14 January 2006-April 8 2009, only 10 were on target, killing 14 alleged Al Qaeda. In the process almost 800 Pakistani civilians have been killed, while many lost their homes and limbs.

Despite its military surge effort, the US will eventually pack up and leave like the Soviets, but the “do more” mantra could end up destroying the Pakistan army - especially the ISI which is being targeted specifically for the mess created by the Bush Administration in Afghanistan.

Myth No. 6: That Pakistan could be Talibanised with their version of Islam.

Both Musharraf and Zardari have contributed to this myth in order to get US backing and dollars. Firstly there is no such precedent in the 15-hundred years of Islamic history of a theocracy like that of the Taliban, outside of the recent Taliban period of rule in Afghanistan. However, as mentioned earlier, the Taliban’s ascendancy in Afghanistan was not a result of their religious ideology but their ability to establish order and security in a war-devastated and anarchic Afghanistan.

In Swat, the present mess has arisen because of poor governance issues. Also, it was the manner in which the government handled the situation - simply sending in the army rather than providing better governance - that created space for the Taliban. Just as in Balochistan (under Musharraf) when the army was sent in rather than the Baloch being given their economic and provincial rights, similarly the army in Swat aggravated the situation and the present mess was created.

What Pakistan has to worry about is the chaos and anarchy that are going to stem from the radicalisation of our people because of the failure of successive governments to govern effectively and justly. Karen Armstrong, in her book The Battle for God, gives details of fundamentalist movements that turned militant when they were repressed. Ideas should be fought with counter ideas and dialogue, not guns. Allama Iqbal was able to deal with fundamentalism through his knowledge and intellect. The slaughter of the fundamentalists of Lal Masjid did more to fan extremism and fanaticism than any other single event.

Pakistan is staring down an abyss today and needs to come up with a sovereign nationalist policy to deal with the situation. If we keep on following dictation from Washington, we are doomed. There are many groups operating in the country under the label of “Taliban”. Apart from the small core of religious extremists, the bulk of the fighting men are Pushtun nationalists. Then there are the fighters from the old Jihadi groups. Moreover, the Taliban are also successfully exploiting the class tensions by appealing to the have-nots. But the most damaging for Pakistan are those groups who are being funded primarily from two external sources: first, by those who want to see Pakistan become a “failed state”; and, second, by those who wish to see the US bogged down in the Afghan quagmire.

What needs to be done: A two-pronged strategy is required - focusing on a revised relationship with the US and a cohesive national policy based on domestic compulsions and ground realities. President Obama, unlike President Bush, is intelligent and has integrity. A select delegation of local experts on the tribal area and Afghanistan should make him understand that the current strategy is a disaster for both Pakistan and the US; that Pakistan can no longer commit suicide by carrying on this endless war against its own people; that we will hold dialogue and win over the Pushtuns of the tribal area and make them deal with the real terrorists while the Pakistan army is gradually pulled out.

At the same time, Pakistan has to move itself to ending drone attacks if the US is not prepared to do so. Closure of the drone base within Pakistan is a necessary beginning as is the need to create space between ourselves and the US, which will alter the ground environment in favour of the Pakistani state. It will immediately get rid of the fanaticism that creates suicide bombers as no longer will they be seen to be on the path to martyrdom by bombing US collaborators. Within this environment a consensual national policy to combat extremism and militancy needs to be evolved centring on dialogue, negotiation and assertion of the writ of the state. Where force is required the state must rely on the paramilitary forces, not the army. Concomitantly, Pakistan needs serious reforms. First and foremost we have to give our people access to justice at the grassroots level - that is, revive the village jury/Panchayat system. Only then will we rid ourselves of the oppressive “thana-kutchery” culture which compels the poor to seek adjudication by the feudals, tribal leaders, tumandars and now by the Taliban also - thereby perpetuating oppression of the dispossessed, especially women.

Second, unless we end the system of parallel education in the country where the rich access private schools and a different examination system while the poor at best only have access to a deprived public school system with its outmoded syllabus and no access to employment. That is why the marginalised future generations are condemned to go to madrassahs which provide them with food for survival and exploit their pent up social anger. We need to bring all our educational institutions into the mainstream with one form of education syllabus and examination system for all - with madrassahs also coming under the same system even while they retain their religious education specialisation.

Third, the level of governance needs to be raised through making appointments on merit in contrast to the worst type of cronyism that is currently on show. Alongside this, a cutting of expenditures is required with the leadership and the elite leading by example through adoption of an austere lifestyle. Also, instead of seeking aid and loans to finance the luxurious lifestyle of the elite, the leadership should pay taxes, declare its assets and bring into the country all money kept in foreign banks abroad. All “benami” transactions, assets and bank accounts should be declared illegal. I believe we will suddenly discover that we are actually quite a self-sufficient country.

Fourth, the state has to widen its direct taxation net and cut down on indirect taxation where the poor subsidise the rich. If corruption and ineptitude are removed, it will be possible for the state to collect income tax more effectively.

A crucial requirement for moving towards stability would be the disarming of all militant groups - which will a real challenge for the leadership but here again, the political elite can lead by example and dismantle their show of guards and private forces.


Finally, fundamentalism should be fought intellectually with sensitivity shown to the religious and heterogeneous roots of culture amongst the Pakistani masses. Solutions have to be evolved from within the nation through tolerance and understanding. Here, we must learn from the Shah of Iran’s attempts to enforce a pseudo-Western identity onto his people and its extreme backlash from Iranian society. The threat of extremism is directly related to the performance of the state and its ability to deliver justice and welfare to its people.

Whilst the whole of the country was in a state of trance [at least apparently ] talking about Justice and all the rule of law during the Lawyers Movement, the Antagonist as well as the Protagonist both knew that no change can be called a change when associated with a person. We are dealing with people who are normal as anyone should be, we all are sinners, and we all have had our dark alleys where we bargain our ethics and our norms.

Paksitan today is on the verge of a paradigm shift.. we have heard this cliché’ before as well not once not twice but this very cliché’ is the beginning of the speeches of all our politicians. but they fact is that words become meaningless when repeated too often as a lie.

I happen to live in Karachi, where according to some Taliban are just about to knock our doors too , for over a week a new violence spree has been witnessed by karachiites much to their horror , and its not even mentioned in mainstream media. Why because Baluchistan is witnessing a shutter down strike, NWFP has its own issues, FATA is being managed by armed forces in the best way possible, and Punjab is still being negotiated for the places where to sit in opposition or Provincial Cabinet.

Be it politicians or people in main stream media ,analysts or Former Civil Services officer every one talk about war on terror and the role of Post Soviet Afghanistan war in Pakistan linking it with the current situation in Pakistan, but only few tend to actually define the problem that actually invited and continues its invitation for a foreign intervention and a weakened state of writ – The fact that we are yet to witness a leadership that takes its responsibility for its actions and future goals.

Taliban are no different from these very politicians in the manner that they don’t care for ordinary lives and humanity, their goal is to establish a writ of their own. A Principle that might is INDEED right, they can be foreign aided, some of them may be even foreigners as well but not all, most of them belonged to the same society we live in, deprived of all the necessities that shape up a man in to human. They are no scholars therefore their version of Islam is of entirely different nature than that of the one led by Prophet Muhammad SAW.People of this country want Justice, and Peace and Equality for All, I repeat Justice, Peace and Equality in that very order.


This Battle may become a battle of two villains – Taliban and Politicians, anarchy will be further augmented for a while but from an optimist point of view this may pave way for those who were never able to serve this country because of a corrupt system in place.

ISLAMABAD, Pakistan—Two distinct sketches are emerging of what happened in Pakistan’s largest province –Balochistan— over the past ten days.



The three murdered Pakistani Baloch political activists were in contact with Pakistani security and intelligence officials during the negotiations to release John Solecki, an American citizen and U.N. official. The three were also in contact with U.S. diplomats, U.N. officials, and with the kidnappers. In fact, the three politicians were considered to be part of the political front of the terrorist-insurgent movement that has its logistical, financial, and military bases in Afghanistan, built with generous funding over the past five years after the American occupation of that country.



So there is no question that Pakistan’s security agencies were in direct contact with the three politicians. Before their murder, the terrorists-separatists did not dare publicize their presence and actions and relied on sporadic violence to spread terror and create media impact. The triple murder changed everything. It gave these separatist and terrorist elements an opportunity for the first time to publicly display their anti-Pakistan activities. In a tribal society like that of the Pakistani Baloch, controlled by a handful of tribal bosses through intimidation, brutality and economic control, the majority succumbed to the terror.



But who murdered the three local politicians?



The following report is based on firsthand information of what transpired between April 4 and April 9, five days that give the clearest insight yet into the wider battle in and around Pakistan.



THE CAPTORS



What is beyond doubt is that Mr. Solecki was kidnapped by terrorists trained and financed by Brahamdagh Bugti, a grandson of the late politician-turned-terrorist Akbar Bugti. [Mr. Bugti was a smalltime village thug who murdered his cousins and relatives, stole their lands and exiled them to other parts of Pakistan. He got lucky when huge reservoirs of natural gas were found in the lands under his forced control. Mr. Bugti received a fortune every year from the federal government as ‘royalty’ for selling the gas. For three decades, his village lived in abject poverty as Mr. Bugti refused to allow the government to build schools or allow the poor villagers to improve their lifestyles. Mr. Bugti spent the money on building and maintaining a small army, a chain of underground prisons and on defending himself against his numerous enemies. After the occupation of Afghanistan, it is believed that the Indians and the Americans sold him on the idea that he could launch a war for an independent country. He apparently received strong guarantees that he will be supported and protected by the United States and India in case of an angry Pakistani reaction, which encouraged him to go to extremes. An advanced insurgency infrastructure complete with printed material in Urdu and English, audio and video tapes and propaganda in local dialects was prepared inside Afghanistan and smuggled to Pakistan. Mr. Bugti launched the war in January 2005, with massive supply of weapons and money. He died almost two years later when his own cousins backed by the Pakistani government stormed into his stronghold and seized their lands and forced him to flee to the mountains.]





Brahamdagh was last sighted in Kabul. Indian intelligence agents posing as diplomats in the Afghan capital are some of his most frequent visitors. The Indian diplomacy and intelligence have been keen since 2002 on finding ways to drive a wedge between Washington and Islamabad. India’s diplomatic actions in this regard are well known but the British and the American media have been silent on growing evidence of Indian covert activities in Afghanistan under an American nod.



One of the earliest Indian actions in Afghanistan after 2002 included acting as a spoiler, poisoning the minds of U.S. military commanders on the ground regarding Pakistan. One of the most common tactics has been to identify and penetrate groups of Afghan resistance fighters and then indirectly goad them into attacking the Americans and leaving behind evidence pointing the finger at Pakistan. Similarly, there have been attacks inside Pakistan where evidence was left behind implicating U.S. intelligence operatives to mislead Pakistani investigators.



BRAHAMDAGH’S FRIENDS



One line of thinking in the current Pakistani investigation into the murder of the three politicians is that there is a high probability that the Indians initially encouraged Brahamdagh to kidnap Solecki to add new tensions to the frail Pak-American relationship. That was the original plan. The U.S. media would jump on the story as another example of anti-Americanism in Pakistan and embarrass the Pakistani government and military. The upshot for Brahamdagh would be more international news coverage.



That was apparently the original plan. What Brahamdagh and his handlers did not expect is that the kidnapping would backfire and blow the cover of the terrorists and their links all the way inside Afghanistan.



Immediately after Solecki’s kidnap, the Pakistani authorities wasted no time in reminding the Americans of the information that Pakistan shared at the highest levels with the United States in July 2008 about Indian activities inside Afghanistan. Adm. Mullen and Deputy Director of the Central Intelligence Agency Stephen R. Kappes were shown irrefutable evidence on how the Indians were using Brahamdagh right under the nose of the U.S. military in Afghanistan.



In February 2009, after kidnapping Solecki, Brahamdagh’s men and his backers tried to create the impression that there are many separatist groups backing his cause. The first demand made by the kidnappers was to release Pakistani Baloch women detained by security forces. This turned out to be an outright lie. Prisons in the entire province and other parts of Pakistan were checked and it was confirmed there was not a single Pakistani Baloch woman in jail or detention. No one had registered any case of missing Pakistani Baloch women as the separatist propaganda from Afghanistan alleged. The elected provincial government of Balochistan, which is considered to be sympathetic to the separatist tribal chiefs including Brahamdagh, was allowed access to all parts of the Pakistani security establishment – civilian and military – to ascertain this fact. This proved a blessing in disguise. One of the most lethal propaganda tools exploited by Brahamdagh Bugti and his backers was proven false.



In the initial days after Solecki’s kidnapping, some of the Baloch tribal chieftains sympathetic to Brahamdagh and his grandfather [and equally corrupt and tyrannical like him] tried to mislead Washington and the U.N. against Pakistan by suggesting that Pakistani intelligence agencies were behind the kidnapping of Solecki.



But the Pakistani government moved quickly to turn the tables on the terrorists and their Afghan-based masters.



On Feb. 27, 2009, Frontier Corps Chief Maj. Gen. Saleem Nawaz told reporters in Quetta that all the four major separatist groups that release statements to the media don’t even exist. “Organizations like the Balochistan Liberation United Front, the Baloch Liberation Army, the Baloch Republican Party, and the Baloch Republican Army are one and the same. Brahamdagh Bugti is behind these organizations,” he said. “Brahamdagh is involved in a series of kidnappings, targeted killings, sabotage and attacks on forces and installations in different parts of the province.”



None of these groups existed before the Americans came to Afghanistan in 2001.



So the writing was clear on the wall for the Pakistanis, the United Nations and the United States that the Indians at some level were involved in kidnapping Mr. Solecki through Brahamdagh Bugti and their recruits inside Pakistan and that individuals based in U.S.-run Afghanistan issued the orders for the kidnap.



But did Pakistani intelligence agencies kill the three politicians who helped release Solecki?



Why The Three Were Killed



The timeline here is very important:



4 April 2009: Mr. Solecki is released by the terrorists after receiving a huge payment worth several million dollars.



6-7 April 2009: Mr. Richard Holbrooke receives the biggest cold shoulder any senior U.S. official has received on Pakistani soil since 9/11.



9 April 2009: The mutilated bodies of the three politicians are found dumped in a public area.



Pakistani police, security and intelligence organizations are not beginners in their fields. Even if any one of them were to kill the three activists, no one would have dumped the bodies in full public view and certainly never after a high profile hostage negotiation involving the three murdered activists where they also interacted with U.N. and U.S. officials.



The truth is that the three murdered Pakistani Baloch politicians had become a political liability and a security risk for Brahamdagh Bugti and a threat to his entire infrastructure of terror inside Pakistan. The three had developed a good working relationship with Pakistani security officials during hostage negotiations. Brahamdagh and his handlers knew that the three were in direct contact with Pakistani security officials and could compromise the security of the terrorist activity and the routes of secret funding from across the border and the terrorist hideouts inside Pakistan



Mounting evidence indicates that Brahamdagh or his handlers in Afghanistan ordered the elimination of the three Baloch politicians. The triple murder has clearly served the interest of the separatists-terrorists and their backers. The Pakistani state has been a net loser.



THE AMERICAN CONNECTION



After Mr. Holbrooke’s failed visit to Pakistan on April 6 and 7, three things happened in fast succession.



One, Britain discovered a “very big” terrorist plot, as a British police officer described it, involving 12 Pakistani students. The British Prime Minister immediately telephoned President Zardari and threw his usual line about Pakistan needing to do more in the war against terror. The interesting part is that the Brits failed to offer any evidence to support the existence of the “very big” terrorist plot. Knowing that the charge won’t stick in the courts, London announced it was arbitrarily deporting the students.



At the same time, Indian prime minister made the startling announcement that the Afghan Taliban, who have never operated outside their country, were planning to bomb Indian elections. Again, no evidence whatsoever.



Pakistani officials smelled a rat in both of these statements coming from two close allies of the United States.



These statements, and the dramatic terrorism in Pakistan’s Balochistan province, came immediately after the dressing down that Mr. Holbrooke received in Pakistan.



Could there be an American connection to the disturbances in Balochistan in addition to the Indian connection? The answer, in my view, is yes. Balochistan has U.S. military bases dating back to 2001. Washington has been opposed to China constructing the Gwadar sea port in the province overlooking the Gulf oil supply lines. And CIA is using Pakistani Balochistan to infiltrate the Iranian province of Sistan-Balochistan and ignite a Sunni rebellion there against Iran’s religious Shia regime.



Within hours of the news that the bodies of the three Pakistani politicians were found near the Iran border, and while separatists and terrorists exploited the story to ignite violence and destroy public property, the U.S. Embassy in Islamabad released a press statement that appeared to pour fuel on fire and give the impression that Pakistan was somehow responsible for killing its own three politicians. The statement was also a blatant interference in an internal Pakistani issue where the U.S. diplomats had no business sticking their noses.



Encouraged by this unexpected support from the U.S. Embassy, some of the opportunist tribal chiefs in Balochistan who are supporting terrorism were emboldened to demand a U.N. probe, scoring a cheap point against Pakistan and implying that the state was involved in the murders.



WHAT PAKISTAN SHOULD DO



Feudal chiefs in Pakistan, whether in Balochistan or Punjab, Sindh, and NWFP, have traditionally been protégés of the British colonial rule. While there are bright exceptions of Pakistani nationalism by some of the feudal gentry, the majority damaged the interests of Pakistan over the longer run and has generally shown little commitment or a sense of nationalism and destiny with regards to the homeland.



For the short term, Pakistan needs to register murder cases against Brahamdagh Bugti and other terrorists. They should be charged of murdering the poor Pakistani Baloch driver who accompanied Mr. John Solecki’s. The driver was killed in cold blood by Brahamdagh’s terrorists.



The issue of Balochistan is part of a wider problem facing a failed Pakistani political system led by failed feudal politicians. This system needs to be changed and de-politicized to focus on economic development and providing opportunities to Pakistani citizens.



Ethnic-based provinces need to be abolished and existing districts converted into provinces with their own directly elected governors and local parliaments and development budgets. This way Pakistani politics will be localized and prevented from becoming a source of constant headache and destabilization for the state.



This change cannot come through democracy and requires a period of technocratic government backed by the military in the background and tasked with strictly executing a list of urgent political and administrative reforms.



The U.S. is clearly working against Pakistan’s vital security and economic interests in the region. Islamabad should declare Washington’s occupation of Afghanistan as illegal and advise the U.S. to desist from using Afghan soil to destabilize neighboring countries. Pakistan needs to immediately distance itself from the messy American agenda in Afghanistan that is fast turning Pakistan into a war zone. Islamabad should also confront the Americans and the Indians with the evidence that both are exporting terrorism into Pakistan and fostering insurgencies using the Afghan soil. Let the world know what the Americans and their Anglo-Indian poodles are doing in the region.

Regulation to provide for Nifaz-e-Nizam-e-Sharia’h through Courts in the Provincially Administered Tribal Areas of the North-West Frontier Province, except the Tribal Area adjoining Mansehra district and the former State of Amb.Preamble.---WHEREAS it is expedient to provide for Nifaz-e-Nizam-e-Sharia’h through Courts in the Provincially Administered Tribal Areas of the North-West Frontier Province, except the Tribal Area adjoining Mansehra district and the former State of Amb; AND WHEREAS clause (3) of Article 247 of the Constitution of the Islamic Republic of Pakistan provides that no Act of Majlis-e-Shoora (Parliament) or a Provincial Assembly shall apply to a Provincially Administered Tribal Area, or any part thereof, unless the Governor of the Province in which the Tribal Area is situated, with the approval of the President, so directs, and in giving such direction with respect to any law, the Governor may direct that the law shall, in its application to a Tribal Area, or to a specified part thereof, have effect subject to such exceptions and modifications as may be specified in the direction; AND WHEREAS clause (4) of Article 247 of the Constitution of the Islamic Republic of Pakistan provides that the Governor of a Province, with the prior approval of the President, may, with respect to any matter within the legislative competence of the Provincial Assembly, make regulations for the peace and good government of a Provincially Administered Tribal Area or any part thereof; NOW, THEREFORE, in exercise of the powers aforesaid, the Governor of the North-West Frontier Province, with the approval of the President, is pleased-


(i) to direct that the laws specified in column 2 of Schedule I shall apply to the Provincially Administered Tribal Areas as afore said; and


(ii) to make the following Regulation:-


1. Short title, extent and commencement. ---


(1) This Regulation may be called the Nizam-e-Adl (Shariah) Regulation, 2008.


(2) It shall extend to the Provincially Administered Tribal Areas of the North-West Frontier Province, except the Tribal Area adjoining Mansehra district and the former State of Amb, hereinafter referred to as the said area.(3) It shall come into force at once.


2. Definitions. ---


(1) In this Regulation, unless there is anything repugnant in the subject or context,- (a) "A’alim" means and includes a person having advance degree in tafseer-e-Quran, Ahadith-e-Nabvi (Sallallaho Alaihe Wasallam), and/or Fiqh-e-Islami from a recognized institution;


(b) "Chairperson" and "member" respectively mean the Chairperson or, as the case may be, a member of the Committee;


(c) "Committee" means the Committee constituted under paragraph 7;


(d) "Court" means the court of competent jurisdiction established and designated as such under this Regulation, and includes a court of appeal or, as the case may be, a court of revision;


(e) "Government" means the Government of the North-West Frontier Province;


(f) "Muavin-e-Qazi" means a person whose name appears on the current panel of Muavineen-e-Qazi drawn under paragraph 7;


(h) "panel" means the current list of the names of Muavineen-e-Qazi for a specified area;


(i) "paragraph" means a paragraph of this Regulation;


(j) "prescribed" means prescribed by rules made under this Regulation;


(k) "Qazi" means a duly appointed judicial officer as specified and designated in column 3 of Schedule II;


(l) "Qazi Court" means the court of competent jurisdiction established and designated as such under this Regulation, and includes a court of appeal or, as the case may be, a court of revision; (l) "recognized institution" means the Shariah Academy established under International Islamic University Ordinance, 1985 (Act XXX of 1985) or any institution imparting Shariah training and recognized as such by Government;


(m) "Schedule", means a Schedule to this Regulation;


(n) "Sharia’h", means the injunctions of Islam as laid down in Quran Majeed and Sunnah-e-Nabavi (Sallallaho Alaihe Wasallam), Ijma and Qias.Explanation.---In the application of this clause to the personal law of any Muslim sect, the expression "Quran Majeed and Sunnah-e-Nabavi (Sallallaho alaihe wasallam)" shall mean the Quran Majeed and Sunnah-e-Nabavi (Sallallaho alaihe wasallam) as interpreted by that sect; and


(2) All other expressions, not expressly defined in this Regulation, shall have the same meanings as assigned to them in any other law for the time being in force in the area to which this Regulation applies." .


3. Application of certain laws to the said area. ---


(1) The laws specified in column 2 of Schedule I, as in force in the North-West Frontier Province immediately before the commencement of this Regulation, and so far as may be, all rules, notifications and orders made or issued thereunder, shall apply to the said area.


(2) All the laws applicable to the said area, including the laws mentioned in sub-paragraph (1), shall so apply subject to such exceptions and modifications as specified in this Regulation;



4. Certain laws to cease to operate. ---


If, immediately before the commencement of this Regulation, there was in force in the said area any law, instrument, custom or usage having the force of law not corresponding to the Injunctions of Quran Majeed and Sunnah-e-Nabvi (Sallaho alaihe Wasallam) provisions of any of the laws applied to the said area by this Regulation, such instruments, custom or usage, as the case may be, shall upon such commencement, cease to have effect in the said area.


5. Courts, Judicial Officers, and their powers and functions. –


(1) Any person to be appointed as Illaqa Qazi shall be a person who is a duly appointed judicial officer in the North-West Frontier Province. Preference shall be given to those judicial officers who have completed Shariah course of four months duration from a recognized institution.


(2) In relation to proceeding with and conducting the criminal or civil cases, all powers, functions and duties conferred, assigned or imposed on Judicial Officers in the North-West Frontier Province under any law for the time being in force, shall, subject to application of such law in the said area and established principles of Shariah, be exercised, performed or discharged by them as designated in column 3 of Schedule II.


(3) A Zilla Qazi shall have the power to authorise, through the District Police Officer concerned, on the basis of special reasons to be recorded about improper investigation, either suo motto or on the request of the concerned Qazi or a party, any other officer of an investigating agency or establishment working within the area of his jurisdiction, in lieu of or in addition to, the investigating officer already authorised, to investigate a particular case and submit his report to the Zilla Qazi about details of his investigation and findings. Where necessary, the Zilla Qazi in the light of the report of the investigating officer specially authorised or any other information, may cause a magisterial inquiry to be conducted against the delinquent investigating officer.


(4) Subject to the general superintendence of the High Court, a Zilla Qazi shall supervise the work of subordinate Courts, and, through the District Police Officer concerned, the investigating officers and officers-in-charge of police-stations in relation to investigation of cases, and of the process serving staff, within the local limits of his jurisdiction, and shall ensure that all matters relating to investigation, in substance as well in procedure, are carried out strictly in accordance with the established principles of Shariah.



(5) It shall be the duty of every officer-in-charge of a police station to ensure that complete challan in each criminal case is submitted to the concerned Court within fourteen days from the date of lodging the first information report, except in a case in which the concerned Qazi has granted special extension of time for a specified period for the reasons to be recorded:Provided that if any officer incharge of police station or investigation officer fails to submit complete challan within specified period, the Qazi concerned shall refer the matter to competent authority for disciplinary action against the police officer responsible for such delay, upon which necessary action shall be taken against him forthwith and shall be duly communicated to the referring Qazi.


(6) The officer-in-charge of a police-station shall submit a copy of the first information report to concerned Qazi within twenty four hours of its lodging, and inform the concerned Qazi from time to time, about the position and further progress of investigation of the case, and act on his directions, if any, concerning investigation of such a case:


(7) All executive authorities in the said area, including members of law enforcing agencies and members of other services of Pakistan, shall act in aid and assistance of the Courts, and shall implement their judicial orders and decisions.


(8) Government may, where necessary, issue such directions to any law enforcing agency as are necessary in relation to the service of Courts' processes on the parties, witnesses or any other person, and, for any general or specific purposes, in order to ensure the conduct of such law enforcing agency in aid and assistance of the Courts.


6. Proceedings to be in accordance with Shariah. –


(1) A Qazi shall seek guidance from Quran Majeed and Sunna-e-Nabvi (Sallallaho Alaihe Wasallam) for the purposes of procedure and proceedings of conduct, resolution and decision, of cases and shall decide the same in accordance with Shariah. While expounding and interpreting the Quran Majeed and Sunna e Nabvi (Sallallaho Alaihe Wasallam) the Qazi shall follow the established principles of expounding and interpreting Quran Majeed and Sunna-e-Nabvi (Sallallaho Alaihe Wasallam), and, for this purpose, shall consider the expositions and opinions of recognized Fuqaha’a of Islam.


(2) No court shall entertain a suit unless the plaintiff verifies that copies of plaint alongwith supporting do*****ents have been sent, through registered post with acknowledgment due to all the defendants, except in case of a suit for perpetual injunction accompanied by an application for temporary injunction.


(3) The pleadings shall be accompanied by attested copies of all relevant public and private do*****ents and affidavits of all the unofficial witnesses duly attested by an Oath Commissioner. The affidavits so submitted shall be treated as examination-in-chief of such witnesses:Provided that if, after submission of pleadings new issue arises in the opinion of court, the party intending to file may be allowed to submit fresh or amended affidavits of unofficial witnesses, as may be necessary for arriving at just conclusion of case.


(4) In all cases of civil nature written statement shall be submitted within seven days and where the defendant fails to do so his defence shall be struck off:Provided that the court may extend time for filing of written statement in extra ordinary cir*****stances.


(5) After completion of evidence, the court shall ask the parties to argue, either verbally or in writing, on the adjourned date, and, if either of the party fails to do so, the court shall pronounce judgment on merits, without any further adjournment for arguments:Provided that it shall be the duty of the court to make list of relevant reported judgments, referred to by any party as precedent, which shall form part of judicial record.


(6) No adjournment shall be granted to either party in any civil or criminal proceedings, except where the court is satisfied that adjournment is unavoidable. In such case the requesting party shall deposit the costs as may be determined by the court.


(7) Soon after the commencement of this Regulation, Government, in consultation with High Court, shall take necessary steps to establish as many courts to ensure expeditious dispensation of justice within prescribed time schedule.


(8) Where the number of pending cases at a time exceeds more than one hundred and fifty in a court of Zilla Qazi or, as the case may be, Izafi Zilla Qazi, or exceeds more than two hundred cases in a court of Aala Illaqa Qazi or, as the case may be, Illaqa Qazi, it shall be necessary to establish a new court to release the work load of the court concerned: Provided that a Qazi posted in the said area shall be entitled to such additional special allowance as may be prescribed.


(9) A period of not more than six months for disposal of a civil case, and a period of not more than four months for disposal of a criminal case, shall be standard time schedule, excluding the time spent for Sulh proceedings.


(10) A Qazi shall finalize a case within the prescribed time schedule and, in case of any delay in disposal of any case beyond such schedule, shall report the cause and reasons of such delay to the Zilla Qazi or, as the case may be, to the High Court, and shall act on the directions issued by such court in that behalf.


(11) If the Zilla Qazi or, as the case may be, the High Court, upon examination of causes of delay, is of the opinion that the delay has been caused due to the delaying tactics of a party, it shall fix a penalty or cost to be recovered from the defaulting party and direct the court concerned to dispose of the case within an extended period of not more than one month.


(12) If in the opinion of Zilla Qazi or, as the case may be, of the High Court, presiding officer of the court dealing with the case or proceeding is responsible for delay in its disposal, the Zilla Qazi or, as the case may be, the High Court may, after providing him an opportunity of hearing, make an entry in his service record.


(13) The Muavin-e-Qazi shall remain associated with the entire judicial proceedings, and shall submit his opinion in writing, which shall be part of the record. Such a Muavin-e-Qazi shall honestly and prudently assist the court in arriving at a correct conclusion regarding the proper application of Islamic laws in the relevant references from Quran Majeed, Ahadith-e-Nabvi (Sallallaho Alaihe Wasallam), Fatawa and other books of Fiqh and Shariah of the recognized Fuqahah of Islam:Provided that a Qazi shall mention the facts of attendance of Muavin-e-Qazi and his submission of written opinion in the order sheet of the case.


(14) In criminal cases, the Investigating Officer shall prepare copies of the case file in triplicate, in addition to judicial file, so that the trial court may retain the judicial file for regular trial, and the remaining two files may be sent to the court concerned when requisitioned.


(15) The Muavin-e-Qazi, who has assisted the court, whose judgment, decree or order is under challenge through appeal or revision, may be called for hearing before the appellate or revisional Court.


(16) An appeal or revision under this Regulation shall be filed within thirty days from the date of the decision in the respective case, after sending its copies, through registered post with acknowledgement due, to the opposite party, and the appellate or revisional court shall decide the same within thirty days, without remanding it on any ground whatsoever:Provided that such court shall have the power to rectify any illegality or irregularity or omission which, in the opinion of the said court, may result injustice to any of the parties.


(17) Any decree shall be executed, either by the court which passed it, or by the court to which it is sent for execution, within sixty days.


7. Muavin-e-Qazi and A’alim Wakeel:---


(1) Government shall, as soon as may be, constitute a committee consisting of the following members, namely.-


(ii) Registrar, Peshawar High Court …………..…………Member

(iii) Secretary to Government of NWFP, Law Parliamentary Affairs and Human Rights,Department; …………………………………………..Member

(iv) District Coordination Officer of the district……….......Member concerned; and

(v) Two eminent A’alims from the concerned …….......…Members district." .



(2) The Committee constituted under sub-paragraph (1), shall have the authority to select Muavineen-e-Qazi, and the names of such Muavineen shall be declared, by notification in the official Gazette, for each calendar year, for each district or protected area, in the form of a panel of up to thirty ulema of known integrity and good character, being well-versed in Sharia’h:


Provided that the names of such persons shall be retained on the future panel, unless the Committee, for reasons to be recorded in writing, decides to delete the name of any person from the panel.


(3) A Qazi shall, for the purpose of expounding and interpreting the injunctions of Islam relevant to the proceedings of a pending case, call upon one or more of such Muavineen-e-Qazi for his assistance.


(4) The Committee may register Ulema, each of whom to be known as A’alim Wakeel, who may be qualified to become Muavineen-e-Qazi to act as Wakeel in the Courts.


(5) Subject to sub-paragraph (6), the Committee may, either of its motion or at the instance of any person, take disciplinary action against a Muavin-e-Qazi or an A’alim Wakeel, and may delete his name from the panel of Muavineen-e-Qazi or as the case may be deregister an A’alim Wakeel.


(6) The Committee shall issue notice in writing to such Muavin-e-Qazi or A’alim Wakeel, specifying the charges against him, consider his written replay, if any, and, if he so wishes, personally hear him, for taking any action under sub-paragraph (5).


(7) Any person aggrieved by the decision of the Committee may apply to the Committee, within one month of the announcement of the decision, for review and the decision of the Committee in review shall be final.


(8) A party to any proceedings before the Court may either conduct the proceedings personally or through special attorney or may duly authorise an Advocate or a duly registered A’alim Wakeel, to act as Wakeel of such party for the purposes of such proceedings:Provided that the Court may provide the services of counsel to a party if, keeping in view the financial position of such party, it so deems necessary.


(9) The name of a person may be included in the panel, or, as the case may be, registered as Alim Wakeel, if he possesses a degree of Shahadatul A’almia or L.L.B. Shariah or B.A. (Theology), or L.L.B. from a recognized institution or university who has experience in Ilm-e-Fiqh and Sharia'h, and teaching of Islamic principles of Sharia'h and jurisprudence related to Islamic laws.


(10) The names of Muavineen-e-Qazi and A’alim Wakeel shall be notified in the Official Gazette, and deletion of any of such name, or as the case may be, deregistration shall also be notified in the official Gazette.


(11) Government shall provide funds to the concerned Zilla Qazi for payment to Muavineen-e-Qazi performing duty in courts within the district.


(12) A Muavin-e-Qazi shall be entitled to such honoraria as may be determined by Government, but shall not demand or receive, directly or indirectly, any pecuniary gain from a party or parties to a dispute pending disposal in, or has recently been disposed of by, a court in the said area.


(13) The concerned Zilla Qazi shall send his comments about the punctuality, regularity, efficiency, honesty, knowledge, capability and other aspects of character of each Muavin-e-Qazi and A’alim Wakeel, to the Committee, before the middle of the month of November in each calendar year.


(14) An A’alim Wakeel shall, for the purposes of conducting cases in Courts established under this Regulation, have the same status, rights, duties and liabilities as an Advocate or pleader appointed or registered under any law for the time being in force, may have.


(15) The Committee may, before the end of the current calendar year, in the light of the comments of the concerned Zilla Qazi, or on any other information or considering the needs of the courts in the concerned area, revise the panel, and may include therein or delete there from the name of any person for reasons to be recorded, and such panel shall be urgently notified in the official Gazette.


(16) The Committee shall meet once in every three months, and may also meet as and when necessary, for- (a) preparation of panel of Muavineen-e-Qazi, and inclusion or deletion of the names of the persons in, or from, the current panel; (b) registration or deregistration of A’alim Wakeel; (c) revision of the panel for the coming year before the end of the current year; (d) interview of persons for appointment as Muavineen-e-Qazi or registration as A’alim Wakeel; (e) hearing the Muavin-e-Qazi or A’alim Wakeel, having objection to the deletion of his name, or his deregistration; and (f) any other matter ancillary, consequential, incidental or relevant thereto.


(17) The Chairperson or, in case of his absence, his nominee, and two members shall form quorum for the meeting.


(18) A meeting may be convened at the request of two members, if the Chairperson, is of the view that the convening of the meeting is necessary.


(19) All the decisions in a meeting shall be taken by majority of votes of the total members.


(20) Government shall provide funds for all the necessary expenses of the Committee.


(21) The office of the Committee shall be located at a place determined by Government in consultation with the Chairperson.


(22) The Secretary of the Committee shall be a person or officer so authorised by Government after consultation with the Chairperson, who shall maintain the record and administratively deal with the business of the Committee.".


8. Power to appoint Musleh. ---


(1) Any civil or criminal case, subject to mutual consent of parties, may be referred to Musleh before recording of evidence, either on the agreement of the parties regarding the names of such Musleh or Musleheen, or in case of their disagreement, to such Musleh or Musleheen whose names appear on the list maintained by the court for such purpose:Provided that the cases falling within the purview of Hudood laws and cases by or against the Federal or Provincial Government or any statutory body or persons under legal disabilities shall not be referred for sul’h.


(2) The Musleheen shall record their opinion with regard to a dispute referred to them with reasons therefor.


(3) Where a Musleh or, as the case may be, Musleheen, to whom a dispute has been referred for resolution, either fail or refuse to resolve it, or the Court is of the opinion that unnecessary delay has been caused, without sufficient reason, in resolving it, the Court, may, on the application of a party or suo motto, for reasons to be recorded, withdraw the order of such reference, and, after such withdrawal, it shall resolve the dispute in accordance with Shariah as if it were not referred for sul’h:Provided that, in no cir*****stances, a case shall remain with a Musleh or, as the case may be, Musleheen for a period of more than fifteen days, and, on the expiry of the aforesaid period, shall stand withdrawn to the court for further proceedings.


(4) The Musleh or, as the case may be, the Musleheen, appointed for such resolution of the dispute, after hearing the parties and their witnesses, if any, perusing the relevant do*****ent, if any, and inspecting the spot, if need be, shall form opinion about resolution of the dispute, with reasons therefor, and submit a report of their opinion to the concerned court without delay:Provided that, in case the opinion is not unanimous, the opinion of the majority members and the opinion of each dissenting member, separately or jointly, with reasons therefor, shall be so submitted.


(5) The Court shall, if it is satisfied that the opinion in a case referred to for sul’h under sub-paragraph (1) is in accordance with Shariah, make it the rule of the Court, and shall announce it as such, but, if the court comes to the conclusion that the opinion is not in accordance with Shariah, it shall declare the opinion, for reasons to be recorded, as null and void and shall start its proceedings for decision of such dispute in accordance with Shariah as if it were not referred for sul’h.


(6) The court shall, before proceeding further, provide an opportunity to the parties to submit objections, if any, to such report, and, if any, objections are so made, the court shall, after hearing the parties, decide about the correctness or otherwise of the objections.


(7) The court may either make the opinion of the Musleh or Musleheen, or the opinion of their majority, as rule of the court and decide the case accordingly, or, for solid and convincing reasons, reject such opinion and proceed further to decide the case in accordance with the established principles of Shariah.


(8) The court shall, keeping in view the actual expenses incurred by the Musleh or Musleheen, on travelling to, and stay at, the place other than the place of his or, as the case may be, their residence, and the time spent in dealing with the case, in particular cir*****stances of each case, fix the remuneration of such Musleh or Musleheen, to be paid by each party in such proportion as may be determined by the court.


9. Conduct of Judicial Officers. ---


(1) The conduct and character of each Qazi shall be in accordance with the Islamic principles.


(2) Notwithstanding anything contained in any law for the time being in force, all cases, suits, inquires, matters and proceedings in Courts, pertaining to the said area, shall be decided by the Courts concerned in accordance with Shariah:Provided that cases of non-Muslims in matters of adoption, divorce, dower, inheritance, marriage, usages and wills shall be conducted and decided in accordance with their respective personal laws.


(3) Government may, from time to time, take such measures for the purposes of sub-paragraph (1) as it may deem necessary.


10. Language of the Court and of its record. ---


All the processes and proceedings of the Court, including the pleadings, evidence, arguments, orders and judgements shall be recorded and conducted in Urdu or in English and the record of the Court shall also be maintained in the said language.


11. Powers to make rules. ---


Government, in consultation with the High Court, may make rules for carrying out the purposes of this Regulation.12. Regulation to override other laws. ---The provisions of this Regulation shall have effect notwithstanding anything to the contrary contained in any other law for the time being in force in the said area.13. Repeal. --- (1) The Provincially Administered Tribal Areas Shari Nizam-e-Adl Regulation, 1999 (NWFP. Reg. I of 1999), and rules framed thereunder are hereby repealed.

and it doesnt stop here ..the latter individual in one of the shows on AAG TV mentioned that intelligence official try and distract him by sending girls to his office and never offered any EVEN A VAGUE proof to the often happening incident according to him.


The above mentioned conversation just goes to highlight the aim behind the staged question answer session, the latter being the individual who happened to PREVARICATE the situation in Fata and Swat at number of times and contradicted by many [with facts] ..examples can with references can be posted here.


The whole crux of the above mentioned incident is to highlight the impact that the conversation can have on a listener / audience who are far away from the subject matter , and only glued to their tv sets so as to know if the forces out side pakistan when say 'Pakistan is a Failed State' do actually mean it.


Stirring agitation and attempting to sully the defenders of the land or the state intelligencia is no patriotism , its a duty that is assigned to those who are getting paid for their services for the anti Pakistan agenda, Consequently those who side with them either willingly or unwillingly are only doing hurting the interests of the Land of Pure.

The Story of Bugti's Death


I am taking a break from writing the Pakistan’s Bermuda Triangle series to discuss what happened in Pakistan’s Baluchistan province early this morning. Some people are making very interesting comments about Akbar Bugti, but noone wants to tell the true story of what caused the action by the military early this morning, so here we go.




Nawab Akbar Bugti (leader of the Bugti tribe), his grandson and 37 militiants were killed early this morning in a massive military operation in Tartani, Baluchistan. I personally don’t have much respect for anyone who is a Nawab and I will explain why, but this discussion is more about the man than the designation he held. Since my family’s background is from the North West Frontier Province (NWFP), which is littered with Nawabs, we have a lot of personal experience with these “leaders” and their methods of control, which I will try to explain.




A Nawab is the king of a specific area. These are remnants from the British rule that used to exist in Pakistan. The British, when pulling out of Pakistan in 1947, gave massive amounts of land to individuals to rule and control as they wished.




Traditionally, the Nawab has never allowed the government to interfere in the workings of their area to the point of taking armed resistances. How do people live in these areas? Everyone who lives and works in an area that has a Nawab is under their control, not the government’s. They receive no benefit from the government nor is the government allowed to enter these areas. Now, it should be clear that these people only exist in the tribal areas of Pakistan (except in Bugti’s case), which are extremely backward and kept that way by these same Nawabs. By backward, I mean no education, no rights, no property ownership, unless the Nawab says so. For example, as a subject under a Nawab, you are required to work their lands, defend their home, and pay a “tax” from your earnings to them. In return, they will exercise a violent rule over the people, jailing them at will, seizing their lands and punishing them for whatever they feel.




If you look at a map of Pakistan, you will see certain areas that are specifically marked as Federally Administered Tribal Areas (FATA), which are mainly on the border with Afghanistan. These areas were set up to absorb the massive Afghani refugee population during the Soviet occupation and their loyalties are firmly with Afghanistan. For those who watch the news, you may have heard the name South Waziristan, Khyber Agency, Mohmand Agency, which are all FATA areas and are the sources of terrorism and massive weapons stores that are used to keep the government out, militiants in and Nawabs in power.




As a matter of fact, my home area of Pakistan was once ruled by a Nawab that gave up power in 1971, when it became part of Pakistan. Prior to that, it had its own military, civil (government), educational and medical structure and did not incorporate itself with any of the laws and regulations of the Government of Pakistan. In 1971, when it formally became part of Pakistan, Wali Swat, our Nawab, gave up his control of the region and disassembled the military militia. But when Wali Swat was in power, the system of government was based on executive order from the Nawab, nothing was written down and everything operated on the whims of the Nawab. But I digress….




Akbar Bugti established his Nawabdom on Pakistani soil, not in a FATA, making him answerable to government laws. Akbar Bugti has been a staunch ally of former Prime Minister Nawaz Sharif, who was exiled by President Musharraf for corruption, extrajudicial killings and various other crimes against the state. He has served as Chief Minister of Baluchistan and was a member of the National Assembly. He hates Pakistan’s other ex-Prime Minister Benazir Bhutto because she allowed rival tribesman to return to Dera Bugti after Bugti kicked them out of the region. When President Musharraf came to power, his first act was to re-settle 10,000 tribesman back into Dera Bugti, again after Akbar Bugti had kicked them out and seized their lands. But none of this is the reason for what happened in the early hours of the morning. Akbar Bugti was involved in anti-state activities. As the President said in July, “Dera Bugti has a population of 9,000; 5,000 of which are now able to return to their homes, with land, cattle and the promise of a better life.”




In December of 2005, while President Musharraf was visiting Baluchistan, Bugti instructed his militia to launch a rocket attack against the President. Earlier this year, Bugti fled Dera Bugti to the mountains when the military started a crackdown against his militia and the illegal arms holds. When I say arms holds, I am not talking about shotguns and grenades; I am talking about rockets, surface to air missiles, mortars, automatic weapons among other military equipment. GEO TV, Pakistan’s largest satellite channel, has been broadcasting recent video footage of Bugti in the mountains watching weapon capabilities being demonstrated, from shotguns to rocket launchers. For almost 7 months, he has been living in a cave, which could only be reached via a long camel ride through the mountains, and using his militia to fight the Pakistan Army. Over the course of the year, hundreds of his tribesman and commanders have accepted amnesty offers from the government and had started handing over their weapons because they were tired of fighting the Army. However, Bugti was not ready to give up the resistance, which brings us to the events of the past few days….




On August 23rd, 2 Army helicopters while flying surveillience missions over the areas were met with ground fire, resulting in the downing of 1 helicopter and heavy damage to the second. The Army sent another helicopter to the area to perform search and rescue, but it was also fired upon and was able to return to base with minimal damage. On the 24th and 25th, another ground search operation was started against the suspected camps where the firing came from, where the Army was again attacked with rockets, machine gun and mortar fire which resulted in the death of 2 additional soliders and 3 injuries. On the 26th, the Pakistan Army started airstrikes against the caves where he was hiding, collapsing the cave after ground forces came under heavy fire.Bugti and his militia are credited with the numerous bombings of the natural gas pipeline running through Baluchistan, attacks on power generation plants and towers. This militia and its leader believed it to be their mission to destabilize the government and cause untold losses to the national resources. Why did he do it? Because Bugti claimed that the natural gas that was in Baluchistan’s earth belonged to his tribe and they should recieve a larger share of the profits for allowing its provision to the rest of the nation. In his words, “The gas belongs to me. It is a Baluchi resource.”Now, you are probably wondering, why did this guy take so much time to explain all of this? If you check any Pakistani newspaper, satellite television channel or web blog, you will find people singing the praises of Akbar Bugti and calling him a “Shaheed” (Martyr), which is unjustified. A martyr dies for an honorable cause, Bugti died for other reasons.From 2 am Pakistan time to the writing of this entry, I have been glued to the television listening to the various political and religious leaders saying that the military operation was unjustified and it could have been resolved by discussion. Hmm… let’s see: Militant walks away from the bargaining table because he isn’t getting what he wants, goes into hiding in the mountains and launches attacks on the Pakistan Army with illegal weapons (successfully shooting down a helicopter and killing Pakistan Army soldiers) and the government should invite him for tea? That’s like asking Osama bin Laden to lay down his weapons and war cry against the West by sitting down at a table and talking to George Bush and Tony Blair? Do you think it would work? When you take a militant stand, you will be dealt with as a militant; not as a politician. I was most shocked at ex-Prime Minister Nawaz Sharif pouring accolades on this man and comparing him to historically respected leaders of Pakistan. What a farce! A corrupt Prime Minister that begged to be exiled to Saudi Arabia, after plundering the country exchequer, only to move to the UK for “medical reasons (read hair transplant).” But then the UK has traditionally been a haven for the criminals of Pakistan like Nawaz, Benazir Bhutto and other Pakistan politicians that won’t return to Pakistan to face numerous criminal charges. A request for the UK government, these people have stolen millions, if not billions, from Pakistan and placed the funds in your country, how about you help Pakistan out and bring them to justice for us?Now, I don’t want to go as far as calling his militia terrorist in nature, but let’s look at the events immediately after Bugti’s death was announced:Massive weapons cache of rockets, surface to air missiles, mortars, automatic weapons among other military equipment-2 banks were set on fire in Quetta, Baluchistan-16 cars at Baluchistan University and the Bolan Medical College’s (Baluchistan) bus were set ablaze (200 students arrested)-Borders from Baluchistan to Punjab and Sindh were sealed by the Army-Quetta has had a full lockdown curfew enforced with the Army patrolling the streets-Karachi, Lahore and Islamabad Police were put on high alert with predominately Baluchi areas put under lockdown-All airports, rail stations and bus terminals have become heavily patrolled areas by the police, Rangers and Army-Even though the whole country is bracing for retailiation, I don’t want to call his militia terrorist in nature…..On the bright side, through the morning, updates reported on the various domestic news channels that people were going to the mosques to give prayers of thanks that this tyrant was removed. People from Dera Bugti are happy, especially when Minister for Information M A Durrani announced that the Bugti lands, bank accounts and assets had been seized by the government and would be re-distributed to the people that had suffered under this tyrant’s rule.The military has vowed to continue the operation until all terrorist activities are brought to an end. So for the remaining Nawabs and militants in Pakistan, either shape up or ship out.
